Terms of Service – The Formational

1. Introduction
Welcome to The Formational (“we,” “our,” “us”). We are a Christian-based educational and coaching platform, registered in New Zealand, offering online courses, coaching programs, events, and resources to customers worldwide.
By accessing or using our website, purchasing our products, or participating in our programs, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use our services.
2. Faith Foundation
The Formational is rooted in the Christian faith, and all our teaching is developed from a biblical worldview. Our content may include spiritual principles and references from the Bible.
We welcome participants from all backgrounds and beliefs. While our programs reflect our Christian convictions, we respect the dignity and freedom of each person to engage according to their own personal convictions.
3. Consumer Rights
Nothing in these Terms limits any rights you may have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any equivalent consumer protection legislation that applies in your country of residence. Where those laws apply, they take precedence over any conflicting provision in these Terms.
4. Eligibility
4.1 You must be at least 18 years old to purchase or register for our programs.
4.2 Our services are intended for adults only. If you are under 18, you are not eligible to participate.
4.3 By using our services, you confirm that the information you provide is accurate and truthful.
5. User Accounts
5.1 Some services require an account. You are responsible for maintaining the security of your login details and for all activity under your account.
5.2 Enrolment is personal and non-transferable. You may not assign your place to another person or share your access details with any third party.
5.3 We reserve the right to suspend or terminate accounts that breach these Terms.
6. Our Programs and Courses
6.1 Content
Our programs may include pre-recorded video sessions, live sessions, downloadable resources, worksheets, coaching, community access, and supporting materials (collectively, “Program Materials”).
6.2 Access Period
Unless otherwise stated, course purchases include access for as long as The Formational continues to operate and offer the program in its current or updated form. We will provide at least 30 days notice before discontinuing any program, and will ensure you can download all available materials before access is removed.
6.3 Changes
We may update or modify Program Materials, platforms, coaches, session times, or delivery methods from time to time, provided the overall value is not materially diminished. We reserve the right to discontinue any program, subject to the notice requirements in clause 6.2.
7. Payments and Currency
7.1 Fees. All prices are listed and charged in United States Dollars (USD) unless otherwise stated.
7.2 Payment Options. You may pay in full at enrolment or select a payment plan if available at checkout.
7.3 Commitment to Full Fee. Selecting a payment plan does not reduce or cancel your obligation to pay the full fee. If any instalment is missed, we may require immediate payment of all remaining instalments.
7.4 Payment Processor. Payments are handled via Stripe. We do not store credit card details on our site.
7.5 Late Payment. If any instalment is more than 7 days overdue, we may suspend access until payment is received.
7.6 International Transactions. If you purchase from outside the United States, your bank or payment provider may convert the charge to your local currency and may apply additional fees. These are your responsibility. We are not responsible for any differences between the amount paid and any amount refunded due to exchange rate fluctuations or bank charges.
8. Refund Policy
8.1 Emotional Wellness Course – 30-Day Satisfaction Guarantee
If you complete the entire course within 30 days of purchase and do not experience meaningful value, you may request a full refund by emailing support@theformational.com with your reason for the request.
To qualify, you must have completed all core modules. This guarantee is designed for participants who engage fully with the material and still find it is not the right fit.
8.2 No Partial Refunds
Refunds are not available for partial completion or change of mind where the course has not been completed.
8.3 Refund Currency
Where a refund is granted, it will be processed in USD for the amount paid at the time of purchase. The amount received in your local currency may differ due to exchange rates or bank charges. We do not cover these differences.
8.4 Other Programs
All other sales are final unless otherwise stated at the point of purchase, or as required by the New Zealand Consumer Guarantees Act 1993 or applicable consumer law in your country of residence.
9. Community Guidelines
Our community is built on respect and biblical values. You agree to:
- Treat all members with kindness and respect
- Avoid abusive, offensive, or discriminatory language
- Keep private discussions confidential unless you have permission to share
- Refrain from harassment, spam, unauthorised advertising, or sharing unlawful material
We reserve the right to remove members from programs or communities for breaching these guidelines. Where removal results in loss of access to a paid program, we will consider the circumstances and any applicable consumer rights before determining whether a refund is appropriate.
10. Intellectual Property
10.1 All Program Materials – including videos, workbooks, frameworks, and course structures – are owned by or licensed to The Formational and are protected by copyright and other intellectual property laws.
10.2 We grant you a personal, non-transferable, non-exclusive licence to access and use Program Materials for your own personal learning during the access period.
10.3 You may not copy, share, publish, resell, or redistribute any Program Materials without our prior written consent.
10.4 “The Formational” and associated branding are our marks. You may not use them without our prior written permission.
11. Disclaimers
11.1 Educational Purpose. All content is provided for educational, personal development, and spiritual growth purposes only. Individual results may vary.
11.2 Not Professional Treatment. Our programs are not a substitute for professional therapy, counseling, psychiatric care, or medical treatment. If you are in crisis or require clinical support, please seek help from a qualified professional.
11.3 No Guarantee. We make no guarantee of any specific outcome, result, or transformation. Your results depend on your personal engagement with the material.
11.4 Personal Responsibility. By participating in our programs, you acknowledge that you are taking responsibility for your own engagement with the material and the decisions you make as a result.
11.5 “As Is” Provision. All content is provided “as is.” To the fullest extent permitted by law, we disclaim all implied warranties.
12. Limitation of Liability
To the fullest extent permitted by law:
- Our total liability to you for any claims arising out of or relating to our programs or services is limited to the total fees you have paid.
- We exclude all liability for indirect, consequential, or special loss or damage of any kind, including loss of income, loss of opportunity, or emotional distress, except where such exclusion is not permitted by applicable law.
Nothing in this clause excludes or limits liability that cannot be excluded under the New Zealand Consumer Guarantees Act 1993 or applicable consumer protection law.
13. Force Majeure
We will not be liable or in breach of these Terms for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, government action, pandemics, or service outages. Where such an event causes material disruption to a paid program, we will make reasonable efforts to reschedule, provide equivalent access, or offer a proportionate credit.
14. Privacy and Confidentiality
14.1 We collect and process your personal data to operate our programs, including your name, email address, and payment information.
14.2 We use trusted service providers including Stripe (payments) and FluentCRM (contact management and email communications), operated on our own website infrastructure. We do not store your credit card details.
14.3 Information shared in group or coaching settings is to be treated as confidential by all participants, except where disclosure is required by law.

15. Termination
15.1 We may terminate your participation if you breach these Terms or engage in conduct we determine to be inappropriate. Where termination results in loss of access to a paid program, we will consider whether any refund is appropriate having regard to the circumstances and any applicable consumer rights.
15.2 Enrolment is personal and non-transferable.
16. Governing Law and Disputes
16.1 These Terms are governed by the laws of New Zealand. The courts of New Zealand have non-exclusive jurisdiction, subject to any mandatory consumer rights in your country of residence.
16.2 If a dispute arises, both parties agree to first attempt to resolve it directly by contacting support@theformational.com. If the matter is not resolved within 14 days, the parties agree to refer it to mediation through the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ) before commencing any court proceedings.
17. Notices
All notices will be sent by email to the address you provided at registration, or to support@theformational.com for notices to us. Email is sufficient for all legal and contractual notices under these Terms. For formal legal correspondence, please mark your email to support@theformational.com as “Legal Notice” in the subject line.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting an updated version on our website before the changes take effect. Your continued use of our services after the effective date constitutes your acceptance of those changes.
19. Miscellaneous
19.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Formational regarding our services.
19.2 No Waiver. Our failure to enforce any right does not constitute a waiver of that right.
19.3 Severability. If any clause is found invalid or unenforceable, the remaining clauses remain in full force.
